These Terms of Service ("Terms") apply when you visit or buy from LEGENDZ Apparel ("we", "us", "our"), including our website and all related services (the "Services"). By using the Services, you agree to these Terms and our Privacy policy. If you do not agree, please do not use the Services.

1. Your Account

You must be at least the age of majority where you live to place an order. Minors may use the Services only with the involvement of a parent or guardian. The information you give us must be correct, current and complete. You are responsible for keeping your account login safe and for all activity on your account, and you may not transfer your account to anyone else.

2. Our Products

We try to show our products as accurately as possible, but colors and appearance may look slightly different depending on your screen and device settings. We may change product descriptions, stop selling a product or limit quantities at any time.

3. Orders

When you place an order, you are making an offer to buy. Your order is accepted only when we confirm it, and we must receive your payment first. We may decline or cancel an order, for example if a product is unavailable or there is an error in the price or description. If we cancel an order you have paid for, we will refund you in full and let you know using the contact details you gave at checkout. Purchases are for your own personal use, not for resale.

Returns and exchanges are handled under our Refund policy.

4. Prices and Payment

All prices are in US dollars (USD) and may change without notice. You pay the price shown when you place your order, as set out in your order confirmation email. Shipping and any applicable sales tax are added at checkout and shown before you pay. Promotions may have their own terms, which apply if they conflict with these Terms.

5. Shipping and Delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers or events outside our control. If your parcel is delayed, lost or arrives damaged, please see our Shipping policy and contact us so we can help.

6. Intellectual Property

Content on the Services, including text, images, graphics, logos and design, is owned by LEGENDZ Apparel or by its respective owners and is protected by law. The LEGENDZ Apparel name and logo are our trademarks, Shopify's name and logo are trademarks of Shopify, and all other names and logos belong to their owners.

You may use the Services for your own personal, non-commercial use only. You may not copy, reproduce, republish or distribute any part of them without our written permission.

7. Third-Party Tools and Links

The Services may include tools or links provided by third parties. We do not control them, we provide them "as is", and you use them at your own risk and under their own terms.

8. Relationship with Shopify

LEGENDZ Apparel is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with LEGENDZ Apparel. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and LEGENDZ Apparel, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with LEGENDZ Apparel.

9. Privacy

Personal information you give us is handled under our Privacy policy. Because our store is hosted by Shopify, some of it is also processed by Shopify under the Shopify Consumer Privacy Policy.

10. Reviews and Feedback

If you send us reviews, ideas or feedback, you allow us to use, publish and share them for any purpose, including commercial use, without payment to you. Your feedback must be your own, lawful and not misleading, and you must tell us if you received anything in return for it. We may remove any content we consider unlawful, offensive or misleading.

11. Errors

Our website may sometimes contain errors in product descriptions, prices, shipping costs, delivery times or availability. We may correct errors, update information and cancel orders affected by an error at any time, even after you have placed your order.

12. Acceptable Use

You may use the Services for lawful purposes only. You must not:

  • break any law, or infringe our rights or anyone else's;
  • harass, abuse or harm anyone, or give false or misleading information;
  • send spam, pretend to be someone else, or collect other people's personal information;
  • upload viruses or malicious code, or try to get around our security;
  • copy, resell or scrape any part of the Services with bots, scrapers or other automated tools without our permission.

Any software agent, including an AI agent, that accesses the Services must clearly identify itself as an agent in its requests, answer truthfully if asked whether it is automated, and must not get around measures that limit automated access, such as CAPTCHAs. We may suspend or close your account if you break these Terms.

13. Termination

We may end these Terms or your access to the Services at any time without notice. You will still be responsible for any amounts you owe. Sections that by their nature should continue, such as intellectual property, disclaimers, limitation of liability, indemnification and governing law, will continue to apply.

14. Disclaimer of Warranties

Except as expressly stated by LEGENDZ Apparel, the Services and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Services will be uninterrupted, secure or error-free. Some jurisdictions do not allow these exclusions, so they may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, LEGENDZ Apparel, Shopify and their affiliates, partners, employees, service providers and licensors are not liable for any injury, loss or claim, or for any direct, indirect, incidental, special, punitive or consequential damages, including lost profits, revenue, savings or data, arising from your use of the Services or any product bought through them, even if advised of their possibility.

16. Indemnification

You agree to indemnify and hold harmless LEGENDZ Apparel, Shopify and our affiliates, partners, employees, agents and service providers from any claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or anyone's rights, or your use of the Services.

17. General

  • Severability: if any part of these Terms is found unenforceable, the rest still applies.
  • Waiver: if we do not enforce a right, we have not given it up.
  • Entire agreement: these Terms and the policies posted on our website are the whole agreement between you and us, and replace any earlier versions.
  • Assignment: you may not transfer your rights under these Terms without our written consent. We may transfer ours.
  • Headings: headings are for convenience only and do not change the meaning of these Terms.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, where LEGENDZ Apparel is based. You and LEGENDZ Apparel agree to the jurisdiction of the state and federal courts located in California.

19. Changes to These Terms

We may update these Terms from time to time by posting the new version on this page. We will give notice of material changes as required by law. If you keep using the Services after changes are posted, you accept the updated Terms.
